Terms of Service

1. Agreement to Terms
By accessing or using Crowdpulse ("the Service"), operated by Webtential ApS ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
Crowdpulse is a live audience feedback platform that enables presenters to create interactive sessions with polls, Q&A, word clouds, and reactions. Audience participants can join sessions and provide real-time feedback.
3. Account Registration
To use certain features, you must create an account using Google sign-in or a magic link sent to your email. You are responsible for maintaining the security of your account and for all activities that occur under it. You must provide accurate and complete information when creating your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Transmit harmful, offensive, or objectionable content through polls or Q&A
- Attempt to gain unauthorized access to the Service or its related systems
- Interfere with or disrupt the integrity or performance of the Service
- Use automated systems (bots, scrapers) to access the Service without permission
- Impersonate any person or entity or misrepresent your affiliation
5. Subscriptions and Billing
Crowdpulse offers free and paid subscription plans. Paid subscriptions are billed through our payment partner, Paddle.com Market Ltd ("Paddle"), who acts as the Merchant of Record for all transactions. When you subscribe to a paid plan:
- Paddle processes all payments, handles tax calculation, and issues invoices
- Your subscription renews automatically at the end of each billing period unless cancelled
- You can cancel your subscription at any time; access continues until the end of the current billing period
- Price changes will be communicated at least 30 days in advance
Refunds are handled according to our Refund Policy.
6. Intellectual Property
The Service and its original content, features, and functionality are owned by Webtential ApS and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any content you create through the Service (e.g., poll questions, session data).
7. User Content
You are responsible for any content you submit through the Service, including poll questions, Q&A responses, and session titles. We reserve the right to remove content that violates these terms. We do not claim ownership over your content but you grant us a limited license to store, display, and process it as necessary to provide the Service.
8. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may occasionally perform maintenance or updates that temporarily affect availability. We will provide reasonable notice for planned maintenance when possible.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Webtential ApS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
We may suspend or terminate your account if you violate these terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.
11. Changes to Terms
We reserve the right to modify these terms at any time. We will notify registered users of material changes via email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
12. Governing Law
These terms are governed by and construed in accordance with the laws of Denmark, without regard to conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Denmark. If you are a consumer in the EU, you also have the right to bring proceedings in the courts of your country of residence.
